Ginny Davis Petition Update #2
Hi all.
I received notice from the court that the associations Motion to dismiss the petition as amended will be heard on May 29th. As that date is later the the date the ballots go out, I will have to file a restraining order to have the judge put my name on the ballot. With that the option, I have sent the following email to Rich Deforge and the lawyer they have handling the case. Please feel free to put this response on facebook and the website.
Here it is:
Hi
I just want everyone to know in advance that if the Board wishes to avoid an added layer to the Motion for Declaratory Judgement they must change their position and allow me to run for the Board of Directors.
I had hoped to bring this up at the March meeting, which was of course cancelled. Then I hoped to bring it up at the April meeting, which will be held on Zoom, potentially limiting access. Even the April meeting is timely as the ballots do not go out until May. However, as the Zoom access is rather limiting, I want to make certain that all involved are aware of my position prior to that meeting. With that in mind, I will make certain that my intent is put on the facebook page and I of course would appreciate it being included on the agenda and, if possible, on the website.
I am aware that the emergency restraining order will wind up costing the association money as the Board chose to hire a lawyer for this matter. This, I want to give the Board the opportunity to reverse their position prior to my filing the restraining order.
Thank you for your attention to this matter.
