Ginny Davis Petition Update

Many people have asked LoveSuissevale what is happening about Ginny Davis' petition. Before the March BOD meeting was cancelled, we asked Ginny for an update. Here is what Ginny sent to us:

First, however, let me remind you that I am not a lawyer and so cannot go into much detail, as I am pretty much figuring this out as I proceed.

I never anticipated this issue becoming such big deal. In my Pollyanna world, I thought I was filing a petition and that a Judge would simply read it and tell us how we should proceed. I felt that if the Board wanted to dispute the petition, they would simply send someone to court and the judge would take both accounts into consideration and then rule. Again, I was looking for an answer as to how we should proceed with future elections and I was willing to spend the money to get that answer.

Also, I filed it in winter thinking that it would move through the Court fairly quickly and quietly and we would get a ruling and be done with it.

However, rather than participating in an action that would give us an answer that we could rely on as being a judgement rather than a simple opinion, the Board has gone to the trouble and expense of having a lawyer file a motion to have the petition dismissed. Additionally, as everyone knows, they chose to expel me from the Board and have informed me that I cannot run in the Spring.

At this point I have amended my petition to ask to be reinstated to the Board and to be allowed to run.

I am waiting to hear back from the Court, which is apparently waiting for an additional filing from Suissevale's attorney.

I was told in January, when I was expelled from the Board, that Suissevale was required to inform our insurance company of the Petition and that informing the insurance company would force us to incur legal expenses. As this is a petition asking the court for a ruling and in no way is a suit for damages, I asked to see the policy and in fact said I would consider withdrawing the petition if I could see the policy. I still have not been allowed to see it.

At this point, it is apparently Suissevale's attorney who is the one holding things up. It would be nice to nudge them along before the meeting because of the election issue.
